Nobleman Clothing Pty Ltd (A.B.N. 83 660 238 871) trading as Nobleman Clothing (“we”, “our” or “us”) values and respects your right to privacy and is committed to safeguarding the privacy of our customers and visitors to our website (Website).  We adhere to the National Privacy Principles established by the Privacy Act 1988 (Cth).  This privacy policy (Privacy Policy) sets out how we collect and treat your personal information.

This Privacy Policy was last updated in July 2023 and includes disclosure of the matters set out in the Australian Privacy Principles.

2.      SCOPE OF OUR PRIVACY POLICY

“Personal information” has the same meaning as it does in the Privacy Act 1988 (Cth).   Personal information generally includes any information that can be used to personally identify you.  

3.      HOW WE COLLECT YOUR INFORMATION

From time to time, we will receive and store personal information you provide to us, whether via our Website, directly or in other forms.

When you purchase something from our store, we collect the personal information you provide to us such as your name, address and email address.

When you browse our store, we also automatically receive your computer’s internet protocol (IP) address to provide us with information that helps us learn about your browser and operating system.

You may provide us with information such as your name, phone number, address and email address so that we can send you information, provide product and order updates, process your product order, arrange for tailoring services and/or arrange for a delivery or return a purchase (our Services).

We may collect additional information at other times, including but not limited to, when you provide feedback, when you provide information about your personal or business affairs, change your content or email preference, respond to surveys and/or promotions, provide financial or credit card information, or communicate with our customer support or other staff.

We may also collect other information you provide while interacting with us at other times.

4.      WHAT WE DO WITH YOUR INFORMATION

We use your personal information primarily to deliver our Services to you.

If you provide us with your permission, we may send you marketing emails about our store, new products, and other updates.

We may disclose your personal information if we are required by law to do so.

By using our Services, you agree to the terms of this Privacy Policy and consent to the collection and use of personal information by us in accordance with this Privacy Policy. 

When using our Website, you represent that you are of competent age to transact online or that you have given us your consent to allow any of your minor dependants to use this Website.

When you provide us with personal information to complete a transaction, verify your credit card, place an order, provide tailoring instructions, provide instructions to enable us to arrange for a delivery or return a purchase, we imply that you consent to our collecting that personal information and using it only for the specific reason you provided it.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your express consent or provide you with an opportunity to say no.

6.      ANONYMITY

You may remain anonymous when dealing with us, however, if you do so, this may prevent us from being able to provide you with our Services.  If you remain anonymous, obvious difficulties may arise, including in the case where you order products that need to be delivered to you.

7.      SQUARESPACE

Our online store (including our e-commerce platform) is hosted on Squarespace.  This is the mechanism that enables us to supply our products to you.

Your personal information is stored through Squarespace data storage, databases, and the Squarespace application. Squarespace stores your data on a secure server behind a firewall. You can refer to Squarespace’s terms of service or privacy statement for further information.  Squarespace’s privacy policy explains how Squarespace handles your data.


If you elect to pay via a direct payment gateway to complete your purchase, Squarespace may store your credit card data.  This information is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS).

PCI-DSS requirements help ensure that your credit card information is handled securely by our store and its service providers.

8.      THIRD-PARTIES

We will not provide your personal information to third-parties without your consent.

When you click on links and banners on our Website that take you to third-party websites, it is the third-party privacy policy that governs your engagement with the site you click on (not this Privacy Policy). We are not responsible for the actions of any third-party websites.  We recommend you read the privacy policy of any third-party service provider (such as payment gateways) you propose to engage with so that you can familiarise yourself with the manner in which your personal information will be used and stored by these third-party providers.

Third-party providers will generally only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

It is important to be aware that some third-party providers may be located in a different jurisdiction than us (including overseas).  This means that, if you engage in a transaction with a third-party service provider, your personal information may become subject to the laws and protocols of the jurisdiction in which that service provider is located.

We recognise the importance of your privacy and have procedures in place to protect and safeguard your personal information. We also have procedures in place so as to destroy or de-identify personal information that is no longer needed and/or if you have requested us to do so.

We follow industry best practices in order to protect your personal information.   We take reasonable precautions to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed (save as requested by you).

If you provide us with your credit card information via Squarespace (as explained above), the information is encrypted using secure socket layer technology (SSL) and stored with an AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

10.  COOKIES

We make use of “cookies” on our Website, which may collect and store your personal information. We use cookies in order to gain statistics on which areas of our Website attract traffic. We also use cookies to enhance your experience of our Website.

Most browsers are set up to accept cookies. You can adjust the settings on your browser in a manner to refuse all cookies or to notify you if a cookie is sent to your computer. By using or accepting our Services, you consent to the use of cookies.

We may, from time to time, use Google Analytics Advertising Features to promote our Services. Google and other third-parties collect data about traffic to our Website via advertising cookies and identifiers.  This enables us to tailor the advertisements that are most relevant to you, based on previous interactions with this Website. Please note that we reserve our right to amend, remove or modify this privacy policy at any time without providing notice. We recommend you check this page regularly to familiarise yourself with any changes we have made to this Privacy Policy.

If changes occur in our corporate structure (for example, we sell our store or merge with another company), we may transfer your information to the new owner so that we may continue to provide products and deliver our Services to you.
